2. Content and Intellectual Property

All content on this website, including the CPR name, logo, mascot (TU Can the Toucan), "If TU Can, you can too!" slogan, audio, images, text and programme artwork, is owned by or licensed to CPR CIC and protected by applicable intellectual property rights. Part B — Giveaway Terms and Conditions

Please read these general terms and the rules for the individual Giveaway before entering. The individual rules explain the prize, who can enter, how to enter, the closing date and how the winner will be selected. Presenters and other excluded persons cannot enter.

1. Introduction and Eligibility

CPR (Coalville Public Radio) may run competitions, giveaways or prize draws (collectively referred to as "Giveaways") from time to time. These Terms and Conditions govern participation in and administration of all Giveaways hosted by CPR.

1.1. Participants must be residents of the UK aged 18 or over. Any further eligibility restrictions will be stated in the individual Giveaway rules before entry opens.

1.2. Presenters, including guest presenters, directors, employees and volunteers of CPR CIC, anyone directly involved in organising the Giveaway or supplying its prizes, and their immediate families and household members are not eligible to enter or win. This applies to paid and unpaid roles. For this purpose, immediate family means a spouse or partner, parent, child or sibling, including step relationships.

1.3. CPR may request reasonable evidence of identity, age, residency and compliance with the eligibility rules before confirming or awarding a prize. Any verification deadline will be reasonable and communicated to the entrant.

1.4. The promoter is CPR CIC, company number 17173702. Correspondence address: CAN HQ, Memorial Square, Coalville, LE67 3TU. These general terms and the individual Giveaway rules will be accessible before entry and throughout the promotion. CPR will administer its Giveaways fairly and in accordance with the applicable CAP Code and Ofcom Broadcasting Code requirements.

1.5. The individual rules must state the entry method, opening and closing dates and times, UK time zone, entry limits, eligibility restrictions, number and nature of prizes, material supplier conditions, selection method, notification process, claim deadline and delivery arrangements. Any significant costs or exclusions must be disclosed before entry. Individual rules supplement these general terms but cannot remove statutory rights or regulatory protections.

2. How to Enter

2.1. Entry methods and any limits on entries will be stated in the individual rules. Only entries received through the specified method within the published entry period will be considered. Entrants must not submit false identities, use automated entry systems or manipulate the entry process. Multiple entries are permitted only where the individual rules expressly allow them.

2.2. No purchase is necessary. Entrants will not be charged by CPR to enter or claim a prize. Ordinary internet, data or standard network charges may apply and will be explained where relevant. These terms do not authorise premium rate entry routes.

2.3. CPR is not responsible for entries that are incomplete, lost, delayed or not received due to technical errors or any other reason beyond its control.

2.4. Where entries incur costs, such as text or call charges, these costs will be clearly specified in the promotional materials.

2.5. Invitations to enter must describe the prize accurately and explain significant conditions. Broadcast invitations must state significant conditions that could affect a listener’s decision to enter at the time of the invitation and explain where to find the full rules. Website or social media links to full terms do not replace the need to communicate significant conditions in the promotion itself.

2.6. CPR will not invite entries after a Giveaway has closed. Repeated or recorded programmes containing an expired invitation must have it removed or clearly identify it as closed.

3. Prizes

3.1. The individual rules and promotion will accurately describe the number and nature of prizes, what is included and excluded, any booking or use restrictions, expiry dates, supplier conditions and any costs payable by the winner. CPR will obtain reliable confirmation of prize availability before launch.

3.2. Prizes cannot be transferred, exchanged or redeemed for cash unless the individual rules expressly provide otherwise. This is subject to clause 3.3 and does not affect statutory rights. No payment to CPR is required to claim a prize.

3.3. If the advertised prize becomes unavailable, CPR will arrange a reasonable equivalent. Wherever practicable, the replacement will be of equal or greater value and discussed with the winner. A supplier’s failure to provide a prize does not remove CPR’s responsibilities as promoter.

3.4. Where a prize is supplied by a third party, the promotion will identify the supplier and explain the arrangements for delivery, collection or redemption. The supplier is responsible for fulfilling its agreed supply obligations. Winners should contact the supplier about practical delivery or service issues and notify CPR if the issue remains unresolved.

3.5. Supplier terms, availability dates, booking conditions and any costs not included in the prize must be disclosed before entry where they could affect a decision to participate. Prizes will be awarded as described or as a reasonable equivalent, normally within 30 days of the closing date unless a later delivery date is clearly stated before entry.

4. Winner Selection and Notification

4.1. The selection method will be published before entry. Prize draws will use a computer process producing verifiably random results or will be conducted by, or under the supervision of, an independent person. Where a competition involves subjective judging, a demonstrably independent judge, or a panel including an independent member, will assess entries against published criteria. Judges must be competent, and their full names will be available on request. CPR will retain evidence of the selection process.

4.2. Winners will be contacted using the method and within the period stated in the individual rules. CPR will take reasonable steps to notify winners and clearly explain how and when to claim. Unless a different reasonable deadline was stated before entry, a winner has 14 days from the first notification to respond. A replacement winner may be selected using the published method if the winner does not respond after reasonable contact attempts or fails the published qualifying conditions.

4.3. Winner selection will follow the method and criteria published before entry. CPR will administer the process fairly and retain appropriate evidence. Nothing in these terms prevents an entrant from making a complaint or exercising their legal rights.

4.4. CPR will publish or make available information demonstrating that a valid award took place, ordinarily the surname and county of major prizewinners and their winning entries where applicable. Entrants will be told about this before entry and may object or request reduced disclosure by contacting admin@coalvillepublicradio.com. CPR will respect appropriate privacy objections but may still provide the relevant information and winning entry to the ASA if challenged. Promotional interviews, photographs and recordings are addressed separately in clause 7.

5. Liability and Cancellation

5.1. CPR may suspend, amend or cancel a Giveaway only where reasonably necessary because of circumstances beyond its reasonable control, fraud, a serious technical failure or a legal or regulatory requirement. CPR will assess the effect on entrants, act fairly and communicate the reason and any changes promptly. This is not an unrestricted right to withdraw a valid prize or avoid an obligation to award it or a reasonable equivalent.

5.2. Subject to clause 5.4 and to the extent permitted by law, CPR is not responsible for losses caused solely by events outside its reasonable control. This does not exclude responsibility for CPR’s own breach of duty or its obligations as promoter.

5.3. CPR does not accept any responsibility for any tax implications arising from a prize.

5.4. The supplier is responsible for the products or services it supplies, including applicable supplier warranties. CPR does not exclude any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms removes a winner’s statutory rights or CPR’s responsibility to award the advertised prize or a reasonable equivalent.

5.5. Where circumstances outside CPR’s reasonable control cause a delay or require a change, CPR will take reasonable steps to limit the impact, notify affected entrants or winners and fulfil its remaining obligations. Cancellation or supplier failure will not automatically extinguish an existing winner’s entitlement.

5.6. Closing dates will not change unless unavoidable circumstances beyond CPR’s control make a change necessary and either retaining the original date would be unfair to people seeking to participate under the original terms, or those people will not be disadvantaged by the change. Low entry numbers alone are not a reason to extend a Giveaway. The general right to update website terms does not allow retrospective changes to a Giveaway that disadvantage existing entrants.

6. Disqualification

6.1. CPR may disqualify an entrant or withdraw a provisional or confirmed prize award where it has evidence that the entrant was ineligible, supplied materially false information, cheated, tampered with the promotion or breached a published qualifying condition. The relevant condition must have been made available before entry.

6.2. Where CPR has reasonable grounds to suspect cheating, fraud, manipulation of entries or another breach of the published rules, CPR may suspend the affected entry, winner confirmation or prize delivery while it investigates. CPR may request reasonable evidence of eligibility and compliance. If the investigation establishes a breach of the published qualifying conditions, CPR may disqualify the entrant, withdraw the prize award and select a replacement winner using the published selection method. CPR will act fairly, retain evidence supporting its decision and give the entrant a reasonable opportunity to respond before a final decision, unless doing so would be unlawful or compromise a fraud investigation.

6.3. Entrants must not threaten, harass or abuse CPR staff, volunteers, suppliers or other entrants in connection with the Giveaway. Any disqualification or prize withdrawal on this ground must be justified by evidence and a clear condition published before entry. If a winner is validly disqualified or fails to complete reasonable verification or claim requirements within the stated deadline, CPR may select a replacement winner using the published selection method.

7. Publicity and Privacy

7.1. Taking part does not automatically give CPR permission to use an entrant’s photograph, voice, video or interview in promotional publicity. CPR will request separate, specific permission for such use. Refusing optional publicity or direct marketing will not affect eligibility, selection or entitlement to a prize. Any intended request for publicity will be disclosed before entry.

7.2. CPR will use personal data to administer the Giveaway, verify eligibility, contact winners, arrange prizes and meet applicable regulatory requirements, as explained in its Privacy Policy. Only information necessary for fulfilment will be shared with the prize supplier, and entrants will be informed of the arrangements.

7.3. Any consent requested for direct marketing will be separate, optional and based on a clear choice. Entrants can withdraw consent using the contact details or unsubscribe method provided. Withdrawal will not affect their entry or prize entitlement. The limited winner information needed to demonstrate a valid award is addressed in clause 4.4.

8. Intellectual Property

8.1. CPR CIC retains intellectual property rights in promotional materials that it creates or owns. Entrants retain ownership of their original entries; entry does not transfer ownership to CPR CIC.

8.2. By entering, entrants grant CPR a limited, nonexclusive licence to use their entry only as necessary to administer and judge the Giveaway and demonstrate a valid award in accordance with clause 4.4. The licence lasts only as long as needed for those purposes and associated complaint or regulatory requirements. Wider promotional use requires separate agreement under clause 7.

8.3. Entrants must own their entries or have the permissions needed to submit them and permit the uses described in clause 8.2. An established breach of a published qualifying condition may lead to disqualification under clause 6.

9. Questions and Complaints

9.1. For questions, privacy objections or complaints about a Giveaway, email admin@coalvillepublicradio.com or write to CPR CIC, CAN HQ, Memorial Square, Coalville, LE67 3TU. Include the Giveaway name, relevant dates and details of the issue.

9.2. CPR will investigate fairly and keep appropriate records. Nothing in these terms prevents an entrant from contacting the ASA, Ofcom or another relevant authority, or exercising their legal rights. Any proposal to resolve a dispute through negotiation or mediation does not prevent access to those routes.

Part C — Advertising and Sponsorship Terms

1. Bookings and Agreements

1.1. All advertising and sponsorship bookings are subject to availability and confirmed only once CPR has issued a written confirmation and any agreed payment has been received.

1.2. Advertising and sponsorship rates are as published on our Advertising and Sponsorship page at the time of booking, unless otherwise agreed in writing.

1.3. Long-term bookings may attract discounted rates by agreement. Any discount applies only for the agreed booking period.

2. Advertiser Responsibilities

2.1. Advertisers and sponsors warrant that all advertising content supplied to CPR is accurate, lawful and does not infringe the rights of any third party.

2.2. All advertising content must comply with the BCAP UK Code of Broadcast Advertising, the Ofcom Broadcasting Code and all applicable UK advertising and consumer protection law. CPR reserves the right to refuse, edit or withdraw any advertisement that does not comply.

2.3. CPR reserves the right to refuse any advertisement at its discretion, including content that is misleading, offensive, politically sensitive or incompatible with CPR's community ethos.

3. Payment and Cancellation

3.1. Invoices are payable in accordance with the terms stated on the invoice. Late payment may result in suspension of advertising until the account is settled.

3.2. Cancellations must be made in writing. Cancellations made with less than 14 days' notice before the scheduled start of a campaign may be subject to a charge, at CPR's discretion.

3.3. CPR is not liable for failure to broadcast an advertisement due to circumstances beyond its control, for example technical failure or force majeure. Where practicable, affected advertising will be rescheduled.

4. DAB and Digital Advertising

4.1. DAB advertising will be available once CPR's DAB service is live to listeners. Until launch, DAB advertising is offered as a pre-launch booking and is subject to the DAB service commencing.

4.2. CPR does not guarantee specific audience figures or listening numbers for any advertising or sponsorship placement.

Part D — Outside Broadcast Bookings

1. Booking and Notice

1.1. CPR prefers at least 4 weeks' notice for outside broadcast bookings. We can accommodate shorter notice, subject to availability, where possible.

1.2. A booking is confirmed only once CPR has issued written confirmation and any agreed deposit or fee has been received.

1.3. Setup and breakdown typically take around 1 hour each and should be factored into event planning.

2. Event Organiser Responsibilities

2.1. The event organiser is responsible for providing safe, level space for the outside broadcast setup, access to power where agreed, and any site-specific requirements communicated in advance.

2.2. Where events require public liability or event-specific insurance proof, the organiser is responsible for supplying documentation in advance.

2.3. The organiser warrants that the event is lawful and that all necessary permissions, licences and consents for the event have been obtained.

3. Cancellation and Liability

3.1. Cancellations by the organiser must be made in writing. Cancellations made with less than 14 days' notice may be subject to a charge to cover committed costs, at CPR's discretion.

3.2. CPR reserves the right to cancel or curtail an outside broadcast due to circumstances beyond its control, including adverse weather, safety concerns or force majeure. Where practicable, CPR will offer an alternative date.

3.3. CPR carries public liability insurance for its volunteers during outside broadcasts. CPR is not responsible for any loss, damage or injury arising from the event itself, which remains the responsibility of the event organiser.

Part E — General

1. Governing Law

1.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

1.2. By using our services or entering any Giveaway, you agree to be bound by these Terms and Conditions.

1.3. Any dispute will first be attempted to be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to alternative dispute resolution, such as mediation, before resorting to the courts of England and Wales.

2. Changes to These Terms

2.1. CPR may update these Terms and Conditions at any time. The current version and date are shown at the top of this page.

2.2. Continued use of our services after a change constitutes acceptance of the updated terms.

3. Contact

For any questions or complaints regarding these Terms and Conditions, please contact CPR at admin@coalvillepublicradio.com or by post to CPR CIC.

Part F — CPR Registered Word Trade Mark and Licensing

1. Ownership

1.1. CPR CIC, company number 17173702, is the registered proprietor of the UK word trade mark “Cpr”, registration number UK00004420673, referred to in this Part as the “Mark”.

1.2. CPR CIC retains all ownership of the Mark. No permission granted under these terms constitutes a sale, assignment or transfer of the Mark, the registration or ownership of either.

2. Permission to Use

2.1. Where our consent is required under our registered trade mark rights, you must obtain a separate written licence signed by an authorised representative of CPR CIC before using the Mark.

2.2. These website terms do not grant a licence. Payment, correspondence, advertising bookings, sponsorship arrangements or previous dealings do not, by themselves, authorise use of the Mark.

3. Scope and Fees

3.1. Any licence grants limited permission to use the word “CPR” solely for the purposes expressly specified in that licence. It does not grant permission to use any logo, artwork or other intellectual property.

3.2. The licence must specify the authorised user, permitted goods or services, manner of use, territory, duration, applicable fees, quality standards and approval requirements. Unless expressly agreed otherwise, permission is nonexclusive and cannot be assigned, transferred or sublicensed.

4. Retained Rights

4.1. The licensee acquires no ownership of the Mark. All goodwill arising from authorised use of the Mark shall accrue to CPR CIC.

4.2. The licensee must not claim ownership of the Mark or apply to register it, or any confusingly similar mark, in its own name.

5. Expiry or Termination

5.1. On expiry or termination of a licence, the licensee must cease using the Mark and remove it from materials and channels under its control, subject only to any arrangements expressly stated in the licence.

6. Limits of This Section

6.1. This Part concerns only CPR CIC’s rights under registration UK00004420673. It does not extend those rights beyond their lawful scope or restrict any use permitted by law without our consent.

7. Licensing Enquiries

7.1. Contact admin@coalvillepublicradio.com. No permission takes effect until the separate written licence has been signed and its conditions for commencement have been met.
